In the Cockerham v. Hanc, O.C.J. decision, the court provides an excellent review of the case law dealing with the issue of spousal support for common law couples. Turning to the question of cohabitation, the court echoed the decision of Molodowich v. Pettinen, in which the courts set out the factors that a court considers to decide whether two parties cohabited or not.
The courts consider the following factors to determine cohabitation: residential arrangements; sleeping arrangements; sexual and  personal behaviour; sharing of household chores and responsibilities; social view of and interactions the couple; societal conduct towards the couple; and financial arrangements of the couple.
