The application of the Hague convention was seen in the Wirta v. Wirta Superior court decision in which the court decided on the issue of the habitual residence of the children and their move from the U.S. to Canada. The court ruled that the children were moved to Canada with the consent of both parents and after moving to Canada and settling here had established Ontario as their habitual residence.
