Considerations for Citizens and Permanent Residents of Canada Interested in Intercountry Adoption

Canadian Citizens and Permanent Residents seeking to adopt a child on an “intercountry” basis have a few matters to consider:

 

1) whether to adopt the child through Provincial adoption agencies or through the adoption agencies of the place where the child habitually resides;

 

2) whether to apply for the child’s sponsorship through citizenship process or immigration process. Canadian Citizens have an option of either processing the adoption through citizenship process or immigration process. Canadian Permanent Residents can only process adoption through immigration process;

 

3) whether the child should undergo a medical exam prior to processing the adoption or not. If the child does not pass the medical exam, their immigration to Canada may be in jeopardy;

 

4) whether the parents should reside with the child in the home country of the child until the child’s immigration application has been accepted by the CIC or should the parents be apart from the child through the immigration process; and,
5) whether they are willing to sign a 10-year undertaking for providing support to the child or until the child turns 25 years old, whichever comes first.
