The Courts of Justice Act grants a party receiving equalization payment the right to obtain pre-judgment interest. The current rate of interest is 8%.  However, the granting of pre-judgment interest is discretionary (Fielding v. Fielding, 2015 ONCA 901 [CanLII]). The Court of Appeal in Fielding indicated that an order for pre-judgment interest may not be appropriate where “the payor spouse cannot realize on the asset giving rise to the equalization payment until after the trial, does not have the use of it prior to trial, the asset generates no income, and the payor spouse has not delayed the case being brought to trial”.  For more information on this issue, read the link below:
