One of the main issues revolving around equalization in a family law matter is the sale of matrimonial home. In most cases, parties agree that the house should be listed for sale. However, sometimes, one party may attempt to hinder the sale thereof unjustifiably. In such circumstances, courts could act as a helpful recourse to list the property for sale; seek co-operation from the other side to list the property for sale; and dispense with the consent of the other side to make improvements to, stage the property or list the property for sale. In the recent  Shahami v. Hashemi-Hefzabad case, the Superior Court of Justice dealt with such issues and gave a fair judgement in the ink of the Honourable Justice Jarvis.
