The date of separation, also referred to as the valuation date, is important in a family law context. It determines the date that shall be used to make equalization calculations and payments. In the Cammaroto v Cammaroto case, the parties turned to the courts to determine their separation date. Although there is no fixed test or condition for the same, the courts considered the following factors that may be of assistance to parties:
A) the date on which the parties ceased to have a sexual or intimate relationship;
B) the degree of communication between the parties;
C) their social interactions as a couple;
D) existence of joint financial engagements including bank accounts, businesses, and investments; and
E) evidence from third parties such as doctors and police regarding the end of relationship
