In Mullin v. Sherlock, the Hourable Mr Justice Emery gave a well thought out decision on the issue of severance of divorce. He dismissed the motion of the husband seeking to sever divorce considering the following factors:
1. Absence of a tangible reason why such a relief is necessary;
2. Affect on the succession rights of the parties;
3. Risk of not being able to inherit estate; and,
4. Lack of production of disclosure of the moving party.
The Honourable Mr. Justice Price denied the appeal of the husband and provided an excellent overview of the law on the issue.
