One of the points of contention in a family law matter is bring able to travel with the children. A parent who has sole custody of the children may still have to obtain consent of the other parent unless they have an order that clearly states that the consent of one parent is dispensed with.
In Rudky v. Kaybaki (2015 ONSC 6431 CanLII) case, the mother had sole custody of children and was seeking an order to permit her to travel with the children without having to obtain the father’s consent. The courts were not inclined to grant that order as there was a concern that such an order will interrupt the equal sharing of special holidays of the parents with the children that the previous order had established. The courts generally encourage equal parenting time between parents and are inclined to make orders that make both parents equally involved in the lives of the children.
