Courts are reluctant to award an order for imputation of income on an interim basis without clear evidence of the income to be imputed. A successful motion relies on detailed affidavits, cross-examination transcripts and other evidence. It is essential that a party seeking an order of this nature have clear, specific, and detailed evidence to establish their case. Absent strong evidence, a party bringing such a motion exposes themselves to cost being awarded against them. The Honourable Mr. Justice Lemon delivered a decision on the issue of imputation of income, on interim basis, in Siddiqui v. Siddiqui (2015 ONSC 6544).
